Fair Housing

AmericanFSBO supports equal access to housing. Every listing, inquiry, and seller response on this site must comply with the federal Fair Housing Act and any state or local protections that apply where the property is located. This page is general information, not legal advice.

What's prohibited

Listings must not state or imply a preference, limitation, or discrimination based on race, color, national origin, religion, sex, familial status, or disability — or on any additional class protected where the property is located. This applies to your description, photos, messages to buyers, and showing decisions.

Write about the property — not the person

Describe objective features: room count, dimensions, condition, improvements, accessibility features, and proximity to services. Avoid coded language about the "right" buyer or family type — phrases like "perfect for a young couple" or "no kids" don't belong in a listing, even when meant innocently.

Selling FSBO doesn't exempt you. Fair housing law applies to owners selling their own homes too (with narrow exceptions). When in doubt, keep every word about the house itself.
