Terms of Service

1. Who we are

AmericanFSBO is operated by Pieter Lombard, sole trader (ABN 78 308 951 013), based in Armstrong Creek, Victoria, Australia. Contact: hello@americanfsbo.com.

AmericanFSBO is a for-sale-by-owner (FSBO) listing marketplace for residential property in the United States. We are not a real estate broker, agent, or multiple listing service (MLS), and we do not represent buyers or sellers in any transaction.

2. The listing service

• One purchase covers one property listing, which stays live until the property sells or you remove it.
• You must be the owner of the property (or legally authorised to sell it) and selling without a listing agent — you confirm this in the FSBO attestation during the listing wizard.
• You may publish one active listing per property address. The address is locked once published.
• You agree to re-confirm your listing every 60 days. If you ignore re-confirmation prompts, your listing will be automatically paused (never deleted) until you re-confirm.
• Listings must be accurate. You are responsible for the content of your listing, including photos, descriptions, and pricing.

3. Pricing and the free trial

• Free trial: new sellers get a 15-day free trial. No card is required to start. When the trial ends, your listing pauses automatically — nothing is ever charged unless you choose to pay for a listing.
• Standard price: a one-time US$99 per listing. No subscription, no renewal, no expiry.
• Founding price: the first 10 sellers to pay in each state get a one-time US$49 rate instead of US$99. Founding spots are first come, first served.
• Listing credit packs: 3-pack US$267, 5-pack US$419, 10-pack US$749. One credit publishes one listing. Pack credits never expire.
• One trial per property address. If a trial was previously used for an address, that address is not eligible for another free trial.
• We can change pricing at any time.
• Prices are in US dollars. Any applicable sales tax will be shown before you pay.

4. What you agree to when you pay

By completing registration or payment you agree to these Terms and our Privacy Policy. We record the version of the Terms you agreed to and the date of your agreement.

After your trial starts, we send you an acknowledgment email confirming: the trial start date, the trial end date, and how to keep your listing live. Keep this email for your records.

5. Acceptable use

You agree:

• to provide true, accurate, and complete information in your listing and account;
• not to list a property you do not own or are not authorised to sell;
• not to use the service for any unlawful purpose, or to post content that is defamatory, misleading, or infringes the rights of others;
• not to attempt to disrupt, scrape abusively, or reverse-engineer the service.

We may suspend or remove listings or accounts that breach these terms.

6. Buyer interactions

• Buyers contact you directly through the listing contact form. We do not screen buyers.
• Listing ratings and comments are moderated. We may remove ratings or comments that are abusive, fake, or misleading.
• For your safety, we recommend standard precautions when showing your home (we publish seller safety tips on the site).

7. FSBO Selling Kit (yard signs)

• The Selling Kit is a physical product fulfilled on demand by our print partner Printify.
• What's included: one double-sided 24"×18" main yard sign with H-stake and a unique QR code linking to your listing, plus your choice of 3 or 5 directional arrow signs with stakes.
• Prices: 3-pack US$79.00 + US$51.95 shipping = US$130.95 total; 5-pack US$109.00 + US$59.95 shipping = US$168.95 total. Shipping is charged at the flat rates shown; no additional fees.
• Each kit is printed with the QR code for your listing — kits are made to order and cannot be resold or returned except where faulty (see below).
• Faulty or damaged kits: contact us within 30 days of delivery with photos. We will arrange a reprint or refund.
• Delivery: kits ship within the United States only. Production and shipping times are shown at checkout.
• The QR code on your sign links to your live listing. If your listing is paused or removed, the QR code will show an unavailable page.

8. Founding Seller package

• The first 10 sellers to pay in each state get the Founding Seller package at a one-time US$49 (instead of US$99).
• Founding spots are first come, first served. When a state's 10 spots are taken, the founding price retires for that state.
• The founding package has no free trial — payment is taken upfront.
• The founding package consumes the introductory offer for your property address — that address is not eligible for a free trial afterwards.
• All other listing terms in §2 apply equally to founding listings.

9. Attorney directory and advertising

• Attorney listings and featured placements are paid advertising, not endorsements. A listing is not a recommendation.
• Direct purchase: directory spots are sold first-come, first-served via instant checkout — no application required. Founding spots ($49/mo) sell first; once they're gone, standard spots ($79/mo, rising to $99/mo at 75% state capacity) open. When a state is full, new buyers join the waitlist.
• Verification: we verify that every purchaser is a licensed attorney after purchase. If we cannot verify your credentials, your placement is removed, your subscription is cancelled, and you are refunded in full. No exceptions — this directory is for licensed attorneys only.
• Founding rate lock-in: the $49/mo founding rate holds only while your subscription stays continuously active. Cancel or miss a payment and you lose founding status permanently — rejoining (even if a founding spot is free) is at the standard rate. Founding spots are never re-offered once filled.
• Monthly billing, paid upfront: directory subscriptions are billed monthly in advance. Each payment covers the next 30 days of your listing.
• No refunds on cancellation: if you cancel your subscription, you are not refunded. Your listing stays live until the end of your paid billing period (30 days from your last payment). After that, your listing is removed and your spot is offered to the next attorney on the waitlist.
• Advertising content is the advertiser's responsibility.

Attorney reviews

• Only verified American FSBO sellers who used a listed attorney to close their deal may review that attorney. Reviews from anyone else are rejected.
• Every review is read by our team before publication. We reserve the right to reject any review for any reason, including spam, fake or unverifiable reviews, abuse, or defamatory content.
• Every attorney has a right of reply to any published review. Replies are also moderated before publication.
• Published reviews and average ratings are shown on attorney listings. Ratings reflect seller experiences, not our endorsement.

Quality standard

• An attorney with 20 or more verified published reviews averaging below 3 out of 5 stars may be removed from the directory at our sole discretion.
• Removal under this quality standard is final. No refunds are given for removal due to quality.
• When an attorney is removed, their subscription is cancelled and their spot is offered to the next attorney on the waitlist.

10. Warranties and liability

To the maximum extent permitted by law, the service is provided "as is" without warranties beyond those implied by law. Nothing in these terms excludes or limits any rights you have under applicable consumer protection law that cannot lawfully be excluded.

To the maximum extent permitted by law, our total liability for any claim arising from your use of the service is limited to the amount you paid us.

11. Fair housing

We comply with the Fair Housing Act. Discriminatory statements in listings are prohibited and will be removed. See our Fair Housing page for details.

12. Copyright (DMCA)

If you believe content on this site (including listing photos or comments) infringes your copyright, send a notice to hello@americanfsbo.com with: (a) identification of the copyrighted work, (b) identification of the infringing material and where it appears, (c) your contact details, (d) a good-faith statement, and (e) your physical or electronic signature. We respond to valid notices in accordance with the Digital Millennium Copyright Act, including removing or disabling access to the material.

13. Children

This service is not directed at children under 13. You must be at least 18 years old to create an account or purchase a listing.

14. Governing law and disputes

AmericanFSBO is operated from Australia by Pieter Lombard, sole trader, and serves customers in the United States. The governing-law and dispute-resolution provisions that apply to these terms are being finalised with legal counsel; this section will be updated when they are confirmed. Nothing in these terms limits any rights you have under applicable consumer protection law that cannot lawfully be excluded or limited.

15. Changes to these terms

We may update these terms from time to time. The version in force at the time of your purchase applies to that purchase. We will note material changes on this page with a new "Last updated" date, and notify account holders by email of changes affecting pricing or cancellation rights.
